    On 14 March 2022, the Cyberspace Administration of China released the new draft Regulations on the Online Protection of Minors (Draft Regulations). They update the 2016 Draft Regulations of the same name which were released for public comment but never adopted.

    On 14 March 2022, the Cyberspace Administration of China released the new draft Regulations on the Online Protection of Minors (Draft Regulations). They update the 2016 Draft Regulations of the same name which were released for public comment but never adopted.
    The latest Draft Regulations have been issued pursuant to the PRC Law on Protection of Minors , PRC Cybersecurity Law and PRC Personal Information Protection Law and reflect the government’s growing concern about the negative impact of the internet on society, particularly its youth – and come hot on the heels of the rules introduced last year that prescribe the amount of time minors are allowed to spend on video games on a weekly basis.
    As the name suggests, the Draft Regulations focus on the protection of minors online, and specifically address and impose obligations on online product and service providers, personal information handlers and the manufacturers or sellers of smart terminals — with additional requirements for important internet service providers. However, they also apply in general to other internet users.

    On 2 March 2022, the Cyberspace Administration of China (“CAC”) issued draft regulations on the administration of internet pop-up push notifications (the “Draft Regulations”). The Draft Regulations were issued pursuant to a number of laws, including the Cybersecurity Law.
    The Draft Regulations bid to further tighten government control over the news followed a human trafficking controversy that erupted on Chinese social media after a woman was found chained by the neck in Xuzhou last month…

    On 2 March 2022, the Cyberspace Administration of China (“CAC”) issued draft regulations on the administration of internet pop-up push notifications (the “Draft Regulations”). The Draft Regulations were issued pursuant to a number of laws, including the Cybersecurity Law.
    The Draft Regulations bid to further tighten government control over the news followed a human trafficking controversy that erupted on Chinese social media after a woman was found chained by the neck in Xuzhou last month, and the invasion of Ukraine.
    However, the regulations also address other aspects of push notifications – including prohibition of algorithmic models that profile minor users and encourage user addiction. This is in keeping with the Chinese government’s broader efforts to reduce the influence of Big Tech, and aligns with the recently issued Internet Information Service Algorithmic Recommendation Management Provisions that came into force on 1 March 2022.
