Vialto Partners Italy STP, con il Director, Nicola Laurenzano, responsabile del Team di Tax Litigation, e il Partner, Paolo Lucarini, ha ottenuto una pregevole sentenza della Corte di Giustizia Tributaria di Secondo Grado della Lombardia, la n. 1387/2024, depositata il 14 maggio 2024, in materia di detrazione del credito di imposta per redditi prodotti all’estero (ex art. 165 del TUIR), in presenza della clausola di “tax equalization”.   I Giudici lombardi hanno statuito la piena legittimità della detrazione di cui sopra da parte del lavoratore, atteso che la clausola di “tax equalization” – in forza della quale l’onere delle imposte estere è sostenuto, per contratto, dal datore di lavoro – non fa venire meno la doppia imposizione sul reddito prodotto all’estero (doppia imposizione economica), presupposto dell’art. 165 del TUIR, che la norma ha lo scopo di rimuove ovvero mitigare. #Italy #vialtopartners #taxes #news #foreigntaxcredit

On October 16th, 2023 the Council of Ministers approved its 2024 budget bill, along with a draft Legislative Decree. Several measures could have a huge impact on the Italian individual tax system if approved. Indeed, all proposed measures will have to go through the Parliamentary/Government technical committees debates and could be amended or cancelled. The final Legislative Decree is expected by the end of December 2023.
