The 4A’s was established in 1917 to promote, advance, and defend the interests of our member agencies, employees and the advertising and marketing industries overall. We empower and equip our members to confidently navigate the ever-changing ecosystem of the agency world. With a focus on advocacy, talent and creating impact, the organization serves 600+ member agencies across 1,200 offices, which help direct more than 85% of total U.S. advertising spend. The 4A’s includes the 4A’s Benefits division, which insures more than 160,000 employees; the government relations team, who advocate for policies to support the industry; and the 4A’s Foundation, which advocates for and connects multicultural talent to the marketing industry by fostering a culture of curiosity, creativity and craft to fuel a more equitable future for the industry.

The Supreme Court's recent rulings have set the stage for significant shifts in how federal agencies, particularly the FTC, regulate the marketing industry. Alison Pepper, executive vice president of government relations and sustainability at the 4A’s, noted, "The Loper decision will restrain the FTC’s ability to make new rules permanent, because judges considering challenges no longer need to defer to the agency on ambiguous areas." Key Implications for Marketers: 🔹 FTC in the Spotlight: Under Chair Lina Khan, the FTC has been assertive in issuing guidelines and fines. Despite these rulings, the FTC remains committed to protecting consumer privacy and fair competition. 🔹 Data Privacy & Sharing: The FTC’s efforts to regulate data brokers and protect consumer data will likely face more pushback. “Data is a hard drug to give up,” says attorney Sean Buckley. 🔹 Marketing to Children: New rules proposed by the FTC to protect children's online privacy may now face more scrutiny and challenges. 🔹 Subscription Cancellations: The FTC's push for easier subscription cancellations could be slowed down, impacting businesses and consumers alike. 🔹 Influencer Marketing: Expect more cautious enforcement of influencer disclosure guidelines. 🔹 Artificial Intelligence: The FTC will continue to navigate the complex landscape of AI regulation, but may need clearer legislative backing.
