Partner Ken Aulet was named a Law360 2024 “Rising Star” for his work representing creditors in major bankruptcies, including BlockFi, LTL Management and Revlon. In a profile, Aulet said his proudest moment as a lawyer was his work seeking to delay attempts by the U.S. Department of Justice to seize assets from BlockFi, which would take away recoveries from creditors who played no role in the alleged fraud. “We developed a novel legal argument in the area where the court acknowledged there was basically no law and as a result delivered a tremendous amount of value to the client,” Aulet told Law360. In an article for The Trademark Lawyer Magazine, partner Ian DiBernardo and associate Marcus Strong evaluate the infringement of voice and likeness in AI-generated works. The article reflects on the recent controversy involving actor Scarlett Johansson and an OpenAI chatbot voice intended to imitate her, as well as a proposed class-action lawsuit brought by two voice actors against artificial-intelligence startup Lovo. The authors also consider proposed legislation intending to address these issues. “Voice products by generative AI companies such as OpenAI have raised questions about how these voices are created and whether they may be infringing on a lesser-known intellectual property right: the right of publicity,” they wrote. Brown Rudnick's M&A Litigation team, led by Dylan Kletter, successfully defended a buyer against claims by a seller seeking over $11 million for alleged breaches related to an earnout provision. "The New York Supreme Court's decision reminds buyers and sellers that New York courts will not allow parties to avoid contractual limitations set forth in a purchase agreement simply by rehashing breach of contract claims as tort claims and that parties should carefully draft language to make clear that limitations of liability apply with equal force to earnout payments," Kletter wrote in a BRiefing with Anthony Boccamazzo.
