5TH CIRCUIT WIN OVER SBA PPP LOAN APPLICATIONS At Crady Jewett McCulley & Houren LLP we are fiercely protective of our clients and their assets. This was recently demonstrated by Carlton Wilde, Jr and John Herrmann from our Commercial Litigation practice, who successfully represented a national bank, rejecting low settlement offers to win both a summary judgment at trial and two successful appeals to the 5th Circuit. “We were confident that our client was in the right at every step of this dispute, a fact which was proven as a matter of law when the trial court awarded our client summary judgment, dismissing all claims presented by the plaintiff and awarding our client its full damages and attorney’s fees, and subsequently affirmed after oral arguments before the 5th Circuit. When the other side threatened a second appeal to stall enforcement of the judgment and to justify their lowball settlement offers, we maintained our position and demonstrated to the 5th Circuit that the plaintiff’s new arguments were meritless” explained John. Not only a win for our client, but an important milestone in reaching a final judgement on the unique issues relating to COVID-era PPP loans. #Litigation #HoustonLaw #PPPloan
