    Some utilities remain concerned about the legalities of Federal Communications Commission guidelines, while others worry that auto-enrollment may risk customer satisfaction. William Raney, a partner at Copilevitz, Lam & Raney, P.C. clarified that The Telephone Consumer Protection Act (TCPA) rules are not directed at outage communications, as the Act governs telemarketing practices. Emergency calls and texts affecting consumers' health and safety, including planned and unplanned outages, are lawful under TCPA.

The industry is divided, as shown by Chartwell, Inc.'s 2024 Outage Communications Survey, which reveals varying strategies across 44 utilities. According to Chartwell’s 2023 Residential Consumer Survey, 40% of customers prefer hourly updates for outages exceeding six hours, while 36% want updates only when new information is available. This highlights a strong correlation between outage notifications and customer satisfaction, giving utilities an opportunity to improve the customer experience by keeping them informed during restoration processes.
