    Partner Christopher Milito was quoted in a July 16 article in The Real Deal that discussed a lawsuit filed by Morrison Cohen on behalf of developer Acier Holdings against lender Parkview Financial, stating that Parkview is undercapitalized and failing to fund The Halo, a massive three-tower development in Newark.     Law.com Pro quoted Partner Keith Markel in an article about the launch of Morrison Cohen’s Luxury Brands industry sector. The new group was created in response to an increase in work from the firm’s luxury brand clients. "Luxury retail has become a predominant part of our practice over the past 10 years," said Keith, who co-chairs the Labor & Employment practice. "Since COVID, we have been working hand in hand with a lot of luxury retail brands with respect to their day to day employment issues." The Luxury Brands team is led by Keith, Andy Bank, chair of the firm's Real Estate practice, and Karim Momin, co-chair of the firm's Emerging Companies and Venture Capital practice.     Cross-border investments can be tricky because parties often are coming from different perspectives.     Morrison Cohen client Ziel Feldman scored a win in a lawsuit brought by Wix Co-Founder Avishai Abrahami. Business Litigation Partner David Ross successfully defended a complex summary judgment motion on behalf of Feldman, the former CEO of real estate firm HFZ Capital Group. The Court, which adopted many of David’s arguments, denied Abrahami’s summary judgment motion, which sought a judgment in excess of $30 million. Earlier this year, Nir Meir was charged by prosecutors as the mastermind behind an $86 million criminal fraud scheme that involved moving money from different HFZ projects. In the instant lawsuit brought by Abrahami, he sought to hold Feldman responsible for a guarantee on a $30 million loan secured in the fall of 2020. However, New York Supreme Court Justice Andrea Masley ruled that Feldman cannot be held liable on the guarantee and ordered the case to go to trial. Justice Masley further said that “Meir misappropriated most of the proceeds from the Abrahami loan,” and that “a trial is necessary to determine whether Feldman ratified the guarantee.” “We are pleased with the court’s well-reasoned decision,” David told The Real Deal. The ruling could be consequential for Feldman who can likely use the judge’s decision to further appeal other lawsuits where judges have ruled that Feldman should be responsible for loans bearing his signature.     Attention Employers: On July 3, 2024, the U.S. District Court for the Northern District of Texas issued a limited preliminary injunction staying enforcement of the Federal Trade Commission's (the “FTC”) Final Rule banning non-compete agreements (the “Final Rule”) solely with respect to the named plaintiffs in Ryan LLC v. Federal Trade Commission. This means that the FTC may not enforce the Final Rule against Ryan LLC, the U.S. Chamber of Commerce, the Longview Chamber of Commerce, Business Roundtable and the Texas Association of Business. However, in her ruling, Judge Ada Brown signaled that the plaintiffs are likely to succeed on the merits and that a full nationwide injunction may follow. Judge Brown intends to rule on the merits by August 30, 2024. For now, non-competes remain effective and enforceable to the same extent as prior to the Final Rule.
