Our law firm was created to help people avoid the harmful effects of traditional scorched earth family court. We help people represent themselves in their family law case to transition their families without destroying them. We provide tools, education and advice so they don't have to go it alone. Our approach was the result of over 33 years of legal experience in which we learned the power of collaborating with our clients to find solutions instead of merely reacting to their legal situations.     Let's talk #ChildSupport #SpousalSupport in #Oregon: Many couples dispute whether one spouse will pay the other spousal support — formerly known as alimony or maintenance — and, if so, how much and for how long. Whether you believe you should receive spousal support or foresee the need to protect against an unreasonable demand you cannot afford, then you'll need to make sure you understand the rules. Whether yours is a high net worth case or a more straightforward case, you need efficient, attentive legal representation that doesn’t unnecessarily waste money on court battles. Settlements that address the needs of all parties avoid the bitterness that can affect your family for years to come. 💡 Types of Spousal Support Available Under Oregon Law: (1) transitional support which is ordered to assist the recipient spouse gain employment and attain self sufficiency 2) compensatory support which is awarded in recognition of the contributions the recipient spouse made to the higher education and arguable enhanced earning capacity of the payor spouse, and (3) spousal maintenance support which addresses disparities in earning capacity where there is a need for supplementation of the recipient spouses’s income for a fixed or unspecified period of time (4) spousal support in lieu of property - although rarely awarded, the court can award spousal support instead of a share in property. The court has discretion over which type -- if any – or combinations of support to award. Traditionally the courts have weighed heavily the ability of the recipient spouse to earn sufficient amounts to provide a standard of living proportionate to that enjoyed during marriage.     ❔ What are Settlement Conferences? 🗨️ Settlement conferences are a type of divorce mediation where you can meet to try to resolve non-child issues such as support (spousal or child), property division and debt assignment. The settlement judge doesn’t decide these issues. She or he will act as a neutral to try to help you both work out a settlement. ❔ Who Should Attend a Settlement Conference? 🗨️You and your spouse/partner/co-parent will meet with a judge who is not assigned to your case or won’t be able to be your trial judge if you don’t settle your case. ❔ When is the Settlement Conference Held? 🗨️ Like mandatory parenting/custody mediation, you can only ask for a settlement conference after you have an open case. That means either you or your spouse/partner or co-parent has already filed papers with the court. ❔ Why Have a Settlement Conference? 🗨️ As of the writing of this post, it’s estimated that between 95%-98% of all cases settle without a trial. So, it’s less a question of if you’ll settle as when you’ll settle. The trick is to settle as soon as you can after you’ve both done your homework so you don’t burn up a lot of time, money and bad feelings before settling. Even if you can’t settle every issue, you can settle some issues. That narrows down what you leave to chance (which is what trials are and why so many families try to avoid them). It also makes it easier to get court time and saves money. ❔ How to Request a Settlement Conference? 🗨️ To get a judicial settlement conference set up, you just need to ask for it. You can do this with a letter or an email. But, unlike custody/parenting mediation, you can’t force your spouse, co-parent or partner to go to a settlement conference. Both sides have to agree which means you have to get their agreement. --- If you have a lawyer, they can walk you through their plan for trying to settle your case; if you are representing yourself, you can talk to an unbundled or limited scope attorney to prepare you for your settlement conference.     💬 What if you want to handle your family law case cooperatively but still need legal help? As you may already know, lawyers have a duty of loyalty to their clients. This duty includes: ✅Keeping the client’s secrets and confidence ✅Identifying and acting in their client’s best interests ✅Not working for a second client’s whose interests may be in conflict with their client For this reason, a family law lawyer cannot advise both parties to a family law case – whether that is two divorcing spouses or two unmarried parents. This is the reason that lawyers typically run “conflict checks” before talking to a new potential client to make sure they don’t already represent or have already consulted with the other spouse or parent. That way, they can ensure that they keep all information confidential and give advice free of any conflict of divided loyalty. ➡️ But what if you and your spouse or co-parent need to get a divorce or legal orders but want to do this cooperatively and without things turning nasty? You may worry that if you both go to your own lawyer, the lawyers will encourage you to take an “adversarial” (or argumentative or hostile or combative) approach which you don’t want. Or you may not have the money to hire two lawyers or you just want to save on expenses. Let’s assume that you don’t want to DIY it because you need help about how to go through the process, make decisions and create the right legal documents.     Did you know? 💡 Over 50% of Oregon divorce cases have at least one person who is representing themselves (“pro se”). 💡 And 90% of ALL cases end up being settled out of court. ️️What this means is that it's more likely than not that you are going to be managing your case in some way. So you can either: ️ ➡️ Hire a lawyer and spend anywhere from $1,500 to $10,000 per month for advice, and be left to manage the rest of your case without advice in the event your budget (or patience!) runs out. ️ ➡️ OR, you can represent yourself from the beginning, get document help, educate yourself about the topics in your case, and get support and advice from legal consulting throughout your case. In this second scenario, you’ll spend less than $5,000 for the whole thing and you’ll have done it YOUR WAY, without compromising your values or your goals. Of course, if you have the funds for all your bills, you won’t be stranded but you may want to consider approaches to working with your lawyer that save some of those funds for a vacation after. 🏖️ The choice of approach is yours.
