More Spokeo (and Transunion v. Ramirez) influences in the debt collection space....mere confusion resulting from not following the fair Debt Collection Practices Act (FDCPA) law does not create sufficient standing to bring an action. Folks who are not lawyers or who don't engage in consumer litigation likely wonder why I often reference Spokeo. I am referring to a prior U.S. Supreme Court case that held that even if a party violates the letter of the law, you (as a private litigant) still may be unable to sue them in (federal court) unless you can prove how you were concretely damaged by that violation. In the consumer financial services and privacy law worlds, Congress has created many laws with specific conduct requirements , such as requiring a debt collector to reveal the name of the original creditor in a debt collection communication so the debtor can lookup other details related to the transaction that created the debt. Under the Spokeo doctrine, if these conduct requirements are violated, you still may have no basis to sue unless you can prove some form of concrete damage to you. In the data privacy realm, this sometimes means that those who have had their data improperly leaked (the Leakee ?) have no cause of action against the Leaker unless the Leakee can show he/she was damaged somehow by the violation.

📸 SNAPSHOT OF THE CURRENT LEGAL MARKET 📸 Law firms are off to a strong start in 2024 compared to 2023 (Thomson Reuters) ✔ Demand for legal services was up 1.9% in Q1, led by Litigation. ✔ Bill rates saw a 6.6% rise, primarily driven by midsize law firms. ✔ Revenue and profits surged by 5.7% and 5.8% respectively. 🙌 Fun fact: The median partner billing rate in M+A surpassed $1,000, marking the first time any practice area has reached this milestone! Figured I'd start this week with some interesting market intel on AmLaw 100 profitability: 🔹 Total Gross Revenue of AmLaw 100 firms is $139,720,251,209 (increased by about 9 billion since 2023) 🔹 Highest Grossing Firm-Kirkland & Ellis 🔹 Firms with the highest increase in PEP were Susman Godfrey, Quinn Emmanuel, Norton Rose, Cravath, & Akin 🔹 Total Number of Lawyers at AmLaw 100-115,043 (1.8% increase since 2022) 🔹 Firm with the highest profit margin is Susman Godfrey, funnily enough this firm also has the fewest lawyers. The average lawyers bills about 2018 hours here. 🔹 Firm with the highest compensation for all partners is Wachtell (approx. $8M)+ and lowest is Gordon Rees (approx. $415K). 🔹 Firms with the highest clocked billable hours are DLA (6.3M ), White & Case (4.5M), Greenberg Traurig (4.3M), Hogan Lovells (3.9M), & Holland & Knight (3.2M). 🔹 The lawyer with the most billable hours was at Cozen O'Connor and billed a whopping 3,792 hours! California employment law moves fast. Here’s your round-up of recent notable headlines. Week of 7/1: - PAGA. Any employer that has experienced a Labor Code Private Attorneys General Act of 2004 (“PAGA”) lawsuit knows #PAGA can be a nightmare. An effort to reform PAGA was headed toward a ballot measure this November, but a deal was announced to head off the ballot measure in exchange for legislative reform. The Governor signed two PAGA reform bills yesterday that may have a significant impact on PAGA lawsuits moving forward. The bills are AB 2288 (https://direc.to/kEn1) and SB 92 (https://direc.to/kEnx). It’s now more important than ever to work with experienced PAGA counsel as soon as you receive a PAGA notice and are named in a PAGA lawsuit. - Speaking of PAGA. PAGA plaintiffs must first provide notice of their PAGA claims to the California Labor and Workforce Development Agency before filing a civil lawsuit. While this is treated as a box-checking exercise by some, failure to properly check the box can defeat a PAGA lawsuit. You can read one such example here. https://direc.to/kEkt. - Arbitration Agreements. #ArbitrationAgreements are essential to defeating wage and hour class action lawsuit, but complications can arise when utilizing workers through staffing agencies. One complication: companies may not be able to enforce an arbitration agreement between the worker and the staffing agency. A recent case is one cautionary example. https://direc.to/kEkq - Warehouse Quotas. Employers that use #WarehouseQuotas must give employees notice of the quotas. Failure to do so can lead to lawsuits and scrutiny from regulators, like here. https://direc.to/kEkM - Overtime Exemptions. Classifying employees as exempt continues to be hotly contested. The United States Supreme Court recently agreed to hear a case to determine what standard employers have to satisfy under federal law to prove an employee qualifies for an #OvertimeExemption. We’ll continue to follow this case as it develops and provide updates as they’re available.   For more insight around these topics and other employment issues, reach out to Louis "Dutch" Schotemeyer and Jason Morris. Attorney client privilege is a powerful tool that allows companies and clients to seek candid legal advice. It’s easy to enforce when a law firm is involved, but can easily be lost when in-house lawyers are asked to give both legal and business advice. If you’re asking for legal advice you think is privileged then you should be clear based on your actions: who you speak with (attorneys only), the setting (private office or open space) and the topic (legal advice, not business decisions).
