New York Employers Must Now Provide Paid Prenatal Leave New York has become the first state in the nation to mandate paid prenatal leave for pregnant employees. Governor Kathy Hochul signed new legislation on April 22, 2024, to expand the New York Paid Family Leave Law (“NY PFL”) to provide 20 hours of paid leave for attending prenatal medical appointments. The new law takes effect January 1, 2025. Employee Handbooks will need to be updated. Expansion of Existing NY PFL Under the updated NY PFL, eligible pregnant employees are entitled to 20 hours of paid leave within a 52-week calendar period to attend appointments for prenatal care, including physical exams, monitoring and testing, and discussions with health care providers. This benefit is in addition to state sick leave or paid leave under the NY PFL. NY PFL provides employees with 12 weeks of paid family leave for qualifying absences such as bonding with a newborn, adopted, or fostered child, or caring for a family member with a serious health condition. Under the new law, employers must provide a separate bank of paid prenatal leave for employees to use without reducing existing paid leave benefits, including paid family leave. Purpose and Broader Trends New York is the first state to provide statewide paid prenatal leave, but this new benefit is part of a growing trend nationwide to provide protection for pregnant workers.  The U.S. Equal Employment Opportunity Commission (“EEOC”) previously released its final regulations interpreting the federal Pregnant Workers Fairness Act. The EEOC’s regulations will require employers to provide reasonable accommodations for pregnant workers, including time off for prenatal or postnatal appointments. However, employers are not required to offer paid leave for prenatal appointments under the federal regulations. That’s me watching HR professionals get up in arms about SHRM (the Society for Human Resources Management, for those not in “the know”) removing equity from their DEI certification and training focus for HR practitioners. 🤣😂🤣😂 C’mon, y'all. It's SHRM. What are y'all up in arms about? They have always been nothing but a tool of capitalism, much like the field they consider themselves a governing body of. They have always been transactional and performative, and their “certified DEI training” has always been transactional and performative. SHRM removing equity from their framework isn’t shocking. Have you seen some of their guides and templates? It’s not like they were actually using an equity lens. And real talk? SHRM certifications have always been hollow, expensive tools to somehow “prove” you’re an HR “professional.” They’ve duped workplaces and a whole industry into believing their pricy certification and its heartless, devoid-of-nuance-and-humanity exam is somehow the standard of an industry and that people without their certification are somehow less-than. That sound equitable to you? Super excited to announce that I passed the exam, and I am now a SHRM Senior Certified Professional! The SHRM-SCP certification is for individuals whose work includes duties such as developing HR policies or procedures, overseeing the execution of integrated HR operations, directing an entire HR enterprise or leading the alignment of HR strategies to organizational goals. The exam includes knowledge-based items that assess knowledge and understanding of factual information, and scenario-based situational judgment items that assess judgment and decision-making skills. The test has an approximately 50% pass rate, so I'm pumped that I nailed it on the first try.
