State Licensing vs Bank Sponsorship Which is better? There is no right answer. At Onbo by Stilt Inc., we were state licensed, and after our acquisition, we led integrations with bank sponsors for lending and banking products. Here's how the 2 approaches compare: 𝗟𝗮𝘂𝗻𝗰𝗵 State Licensing: It’s easy to launch. Some states have a simple application process and almost no costs. Depending on your product, you can even launch without a license. Bank Sponsorship: Have high setup costs + takes time and resources. Requires significant work at launch. 𝗖𝗼𝘀𝘁𝘀 State Licensing: There are no material operating costs, no monthly minimums, and a lower cost structure. Bank Sponsorship: Has higher setup costs, monthly minimums, oversight costs, frequent audits, etc. 𝗣𝗿𝗼𝗱𝘂𝗰𝘁𝘀 State Licensing: States have different usury limits and requirements. e.g. no origination fees, max X% APR resulting in a non-standardized product. No option to offer products like credit cards. Bank Sponsorship: Standardized product across all 50 states. Product parameters could be limited by the bank's charter location. e.g. NJ has max 30% APR. 𝗖𝗼𝗺𝗽𝗹𝗶𝗮𝗻𝗰𝗲 State Licensing: Depending on the state, limited compliance requirements are specific to your product. A few federal regulators like the CFPB also have oversight. Bank Sponsorship: Higher compliance requirements including oversight from OCC, FDIC, etc. 𝗖𝗹𝗼𝘀𝗲𝗱-𝗲𝗻𝗱 𝗮𝗻𝗱 𝗥𝗲𝘃𝗼𝗹𝘃𝗶𝗻𝗴 𝗣𝗿𝗼𝗱𝘂𝗰𝘁𝘀 State Licensing: Multiple states haven’t contemplated revolving credit products. Sometimes, the rates and usury limits could be different for these products. Bank Sponsorship: Revolving products operate within the same framework as the closed-end products. Simpler to expand the product suite. 𝗦𝗲𝗿𝘃𝗶𝗰𝗶𝗻𝗴 𝗮𝗻𝗱 𝗖𝗼𝗹𝗹𝗲𝗰𝘁𝗶𝗼𝗻𝘀 State Licensing: No servicing licenses are needed because the lender is the servicer. Bank Sponsorship: Require additional servicing licenses in 40+ states unless the bank is the master servicer. 𝗥𝗲𝗽𝗼𝗿𝘁𝗶𝗻𝗴 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗺𝗲𝗻𝘁𝘀 State Licensing: States have clear annual reporting requirements either through NMLS or through their own portal. Bank Sponsorship: Bank sponsors require monthly, quarterly, and annual reporting as a part of their monitoring and oversight program. 𝗗𝗲𝗯𝘁 𝗙𝗮𝗰𝗶𝗹𝗶𝘁𝗶𝗲𝘀 State Licensing: No limitations on raising debt facilities. No reporting is required unless it's a part of annual audits. Bank Sponsorship: Bank sponsors will want a say in approving the documents and participation in the loan facilities. 𝗔𝘂𝗱𝗶𝘁 𝗖𝗼𝘀𝘁𝘀 State Licensing: Most states audit annually or at a predefined schedule. Generally, the costs are either zero or not onerous. Bank Sponsorship: Bank sponsors have significant auditing requirements across multiple areas including but not limited to fair lending, compliance auditing, and financial audits. Overall RBI has played a very positive and proactive role in terms of inclusion and creating awareness towards digital payments. As per Richa Mukherjee, Fintech sector has changed drastically in the last few years while sharing her views during a panel discussion at PMOGA India Hub. Richa further highlighted that policy-making dynamics have also changed. All #Fintech companies need to setup robust risk governance framework. The Reserve Bank of India (RBI) has imposed restrictions on Kotak Mahindra Bank, prohibiting it from acquiring new customers through its online and mobile banking channels and issuing new credit cards. However, the directive allows the bank to continue servicing its existing customer base, including credit card holders. The RBI identified significant deficiencies during IT examinations conducted in 2022 and 2023. Despite ongoing engagement, the bank repeatedly failed to adequately address concerns related to IT Risk and Information Security Governance, which are critical under regulatory guidelines, according to the RBI. RBI said these regulatory measures were deemed necessary to protect customers' interests and prevent potential severe disruptions that could impact the broader financial ecosystem, particularly in the digital banking and payment systems. Much awaited Revival of the India IT services sector …seems to be on cards !!! With the Optimistic picture painted by the US Fed chief, the imminent Interest Rate Cut seems to happen ...much sooner than expected. The celebrations in the capital markets have already begun ! Another unexpected event that can auger well for the markets is the likely-hood of Mr Trump winning the presidential elections. If Mr Trump takes the help, there is very high probability for aggressive rate cuts (many) and perhaps even another round of financial stimulus! There are plenty of reasons to believe that Mr Trump will begin his 2nd innings with a big-bang schemes to revive the domestic consumption!   It is incidental that the tariffs imposed by Mr Trump , on the imports (from China) could have been resulted in the High inflation that the US has been facing last 8-10 quarters! It might be that the Domestic industries don’t have the capacities to produce the trade shortfall...leading to high inflation ! It wouldn't be incorrect to say that there aren't any manufacturing industries left in that country to produce .....there by relying purely on the imports !! I believe, post the Tariff war, in the last 3-4 years , the local Manufacturing capacities should have come into effect. And perhaps even the setting up newer supply chains ..bypassing China ! It perhaps took these 4 years for the Trump's tariff-war to yield the desired outcomes !!! In the prospective 2nd term, He may extend this Vitreous-cycle by cutting down the Interest rates and giving those industries a booster dose of Financial incentives. With the Supply side taken care of , the domestic consumption can be revived without affecting on the Inflation!! If Mr. Trump wins , increasingly it seems to be the reality , he would prefer to give more weightage to the domestic priorities , as against the funding for the Ukrin war. With the much awaited Rate Cuts and any additional Financial impetus to the Domestic Manufacturing sectors, It will be a big windfall bounty for the domestic corporates !! An Interest Rate cut , coupled with any Financial stimulus , can induce the required confidence for these Corporates to resume their IT spend !! Indian IT services companies with good exposure to the US market (BFSI, MFG , HiTech sectors) are sure get to benefit alot. !!! Is it the time to bet big on the IT companies ?!
