Today, the Biden Administration announced new policies that would allow the government to rapidly expel asylum-seekers who cross between ports of entry, without individualized review, if border encounters meet a certain threshold. The new policy relies on the Immigration and Nationality Act sections 212(f) and 215(a), laws the Trump Administration used to implement the discriminatory Executive Order 13769, also known as the #MuslimBan

https://lnkd.in/eFWG9tdr Florida’s aggressive anti-immigrant laws imperil and harm thousands of noncitizen state residents, including the state’s estimated nearly 800,000 undocumented residents. However, noncitizens in Florida may be able to benefit from federal immigration policies. These federal policies guide immigration officers in deciding how and against whom to enforce immigration laws. Noncitizens may therefore use one or more of these policies to argue that they should not be subject to arrest or deportation by ICE, notwithstanding Florida’s state laws.

Happy #ImmigrationReviewPodcastMonday! Well, the Senate's Bill is out, and appears to envision funneling more and more asylum adjudication and authority to border officers in lieu of Immigration Judges. How will border officers account for case law differences among the circuits and BIA? Such as, for example, this recent quote from the First Circuit regarding the nexus standard for family-based and other asylum claims. Then again, the First Circuit relies on the immigration statute itself, which always wins, no? : ) Kurzban Kurzban Tetzeli and Pratt P.A.

The San Antonio city council is discussing how the city can fund and support the Migrant Center that serves illegal aliens. By providing taxpayer financial support to the Migrant Center, the city is facilitating illegal immigration and ignoring immigration laws. The city is also encouraging illegal aliens to depend on cartels and criminal gangs to cross the border. Taxpayers will be paying federal and local taxes to support the illegal immigration.San Antonio should not encourage and support illegal immigration. Illegal immigration is ILLEGAL and elected officials should not use taxpayer funds to break the law.Taxpayer money should serve citizens only. SA citizens and taxpayers must say NO to funding any part of illegal immigration. Otherwise, what’s the point of being a lawful citizen if an illegal alien gets the same benefits and rights? https://lnkd.in/gHHrSN3F

Although it is a border bill, the Senate deal does include 18,000 extra Employment-based green cards each year for next 5 years. Kids of H-1B holders would not age out if they spent at least 8 years in H-4 status before turning 21. H-4 employment authorization incident to status for spouse and kids. Is it perfect? No. But it is progress for high skilled immigrants waiting for green cards due to per-country caps. #ImmigrationReform #GreenCardBacklog #H1BVisa #EmploymentBasedImmigration #HighSkilledImmigrants #H4EAD #SenateDeal #ImmigrationPolicy #TechImmigration #USImmigrationReform
