At least 23 states in the country decide civil justice with juries of less than 12 jurors. Massachusetts only requires 6 jurors in District Court cases to decide civil justice. Over the past four (4) years, Massachusetts Superior Courts have only required 6 person juries to deliver civil justice. Historically, the Superior Courts have relied on 12 person juries to deliver civil justice. Research has shown that Superior Court juries at common law were composed of precisely 12 is a historical accident, unnecessary to effect the purposes of the jury system and wholly without significance. Now that the pandemic is the rearview, the Superior Court has reverted back to 12 person juries. This has created delays in jury selection, trial efficiency and deliberations. That is only compounded by the fact that we have a shortage of judges in the Superior Court right now. With the shortage of judges and the backlog from the pandemic, the problem is not going to get better without maintaining some of the efficiencies that were put into the system.
