Specialist fraud disputes & financial crime compliance lawyer | Conference speaker on all things fraud | Founder of award winning law firm Tenet | Trustee Director Fraud Advisory Panel
Our third year of sponsoring The Lawyer’s Managing Risk and Litigation conference in London today 🙌 It’s a great event for in-house counsel who get some dedicated time (in a time poor world) to learn more about responding to known and emerging risks. Whilst fraud has always been a “known” risk I am not sure how many see it as an “emerging risk” when in fact they should. Fraud morphs and shapeshifts to present itself in new forms of attack be it from insiders to cyber and much more. Combine that with an age of it being harder to unravel (think of things like disappearing messages) we face a constant evolution of a threat - the known unknown. Looking forward to seeing some familiar and new faces today 😊

Cyber incidents have unique characteristics that can make it especially difficult to claim or preserve legal professional privilege over documents generated in response, particularly forensic investigation reports. But given cyber incidents are increasingly exposing organisations to expensive litigation and regulatory enforcement action, taking steps before and during an incident to maximise the prospect of privilege attaching to communications, is itself an important risk management measure. Our new guide includes some practical do's and don'ts and incorporates the latest findings from the Optus decision. Jonathan Light Christopher Kerrigan Lauren Holz Andrew Burns Allens

Really interesting read (and not just for governance professionals if you ask me), my key takeaways are: - Skills shortages and resources in general are seen as a key factor affecting the competitiveness of the UK in the short/medium term - The role of AI is being discussed but inconsistently (one to watch for the upcoming year) - Climate change is rapidly climbing up the priority list for boards for both the short and long term. Clarity and alignment for ESG regulation is required to help them on this.

𝐓𝐡𝐞 𝐒𝐢𝐥𝐞𝐧𝐭 𝐁𝐚𝐭𝐭𝐥𝐞𝐟𝐢𝐞𝐥𝐝: 𝐂𝐲𝐛𝐞𝐫 𝐄𝐬𝐩𝐢𝐨𝐧𝐚𝐠𝐞 𝐓𝐚𝐫𝐠𝐞𝐭𝐬 𝐭𝐡𝐞 𝐈𝐂𝐂 🌍 In our contemporary era, where traditional warfare has melded with the digital, the online space emerges as a crucial battleground. 🌐 The International Criminal Court (ICC) – a bastion of global justice – recently found itself in the crosshairs of a meticulously orchestrated cyberattack. This sophisticated assault on the ICC brings to light the vulnerabilities that even our most revered institutions can't escape. While the motive – espionage – stands apparent, the identities of the orchestrators and the depth of the breach remain concealed in shadows. 🕵️♂️ In a world fraught with escalating tensions, this incident serves as a stark reminder: our digital frontiers are becoming arenas for power plays, weaving together the complex threads of politics, justice, and innovation. Gleaning from a rich history in cybersecurity, an undeniable truth surfaces: no organization, no matter its prestige or purpose, stands immune to the threats of the digital age. 🛡️ Reacting with mere stopgap measures won't suffice; a comprehensive, foundational strategy is imperative. The ICC's approach, accentuating enhanced cybersecurity and robust risk management, should be seen as a blueprint for all. The goal extends beyond safeguarding data – it's about upholding trust, integrity, and the very essence of an institution. In these challenging times, has your organization confronted similar threats? How do you bolster your defenses in the face of advancing cyber-espionage? 🚀 #ICC #digitaljustice #geopoliticalrisk #cybersecurity #cyberriskmanagement

Nice executive summary view of the new SEC guidance. #leadership #management #technology #informationsecurity #ciso #riskmanagement #security #cybersecurity #privacy
After many months of discussion and debate, the U.S. Securities and Exchange Commission released its final rule making on Cybersecurity Risk Management, Strategy, Governance, and Incident Disclosure. While not perfect, this rule represents a material step forward in improving the transparency needed by the markets to more effectively gauge the material cyber risks in public companies. The CAP Group is pleased to provide a summary of the key elements of the SEC ruling.
