Yesterday, the U.S. Supreme Court heard oral arguments for a consolidated case (Idaho v. United States and Moyle v. United States) challenging decades of legal precedent of providing emergency care for pregnant people as protected under the Emergency Medical Treatment and Labor Act (EMTALA). Ahead of the final ruling in June, the Supreme Court appeared to be split – a decision the National Association of Nurse Practitioners in Women’s Health hopes the justices can avoid in favor of keeping the life-saving protections of EMTALA. A DNR Order cannot be entered unless the patient has requested it (or the patient’s Healthcare Surrogate). Patients who do not have a DNR are called “Full Code,” meaning that in the event of a heart attack, all measures are to be taken in an effort to save the patient’s life. Many times, when a resident is first admitted to a nursing home or when a patient is admitted to a hospital, the family is asked whether he or she has a DNR and if not, whether you want to sign one. Or you may be asked later on if you want to sign a DNR when your loved one has taken a turn for the worse. You should never feel pressured to sign a DNR; if you are unsure, say no. 📌The private member bill, which was introduced in the Parliament on 4th August, was introduced by Congress MP Tharoor in honour of the late Dr. Vandana Das, who was brutally stabbed to death by a patient. 📌The bill was introduced to make all acts of violence against healthcare personnel, including verbal abuse, a non-cognisable and non-bailable offense. 📌It widens the scope of the definition of healthcare personnel by including within its ambit, paramedical students and workers, administrative staff at hospitals and ASHA workers. 📌The bill provides a definitive time frame for the completion of the investigation of cases registered under the Act and the sentencing of the accused. 📌It provides for the establishment of designated special courts in every district in order to complete trials in a time bound manner. 📌Indian Medical Association estimates that 75 percent of all doctors face some form of physical abuse during their service, with cases of violence severely under reported. 📌The proposed bill will, therefore, check on such violence at the earliest to promote a safe work environment for doctors and all healthcare personnel and serve as a model for state laws." #IMA #PhSquad #Medicare #MedicalHospital #parliamentbill #medicalassociation #asha #ashaworkers #paramedical #hospitalstaff #Indianlaw #medicalstaff #doctors #safedoctor #IMABill

It is notoriously difficult to judge when an application to the Court of Protection (COP) is required in the context of obstetric care and treatment, particularly when a patient has fluctuating capacity, clinicians are concerned the patient may lose capacity during labour, or a birthing plan involves a deprivation of liberty or restraint. #NHS Trusts are often stuck between a rock and a hard place: they are criticised for making applications too late but also for making applications too early and too cautiously. Local authorities also have a role to play, if there are safeguarding concerns about the mother or baby.
