Some thoughts for people recently laid off who may be feeling some things about "underperformance" as a reason: REQUEST YOUR PERSONNEL AND PERFORMANCE RECORDS Especially if you're a worker in California, because it's your right to do so. Workers in any state should still ask; the employer may provide them because they're required to, or because it's the right thing to do. For Californians: California Labor Code section 1198.5 provides every current and former employee the right to access or obtain copies of their personnel records relating to their performance or any grievances concerning them. The California Department of Industrial Relations has stated that “personnel records” include employment applications, payroll authorization forms, warnings, disciplinary and termination notices, layoff and leave documents, wage attachments, education and training records, performance reviews, and attendance records. Employers must maintain a copy of employee personnel record for at least three years. To obtain their personnel file, employees must submit a written request to their employer or the employer’s representative. Typically, an email to human resources, stating “I am writing to request a copy of my personnel file,” is sufficient. However, employers may sometimes provide a specific form for employees to complete when requesting their personnel files. Employees should review their employee handbook for information about who to submit the request to and whether the employee must submit an employer-provided form. Once the employer receives a written request, they must make the personnel file available to the employee within 30 days. It’s important to note that employers are obligated to comply with only one inspection request per year from former employees. (Labor Code § 1198.5, subd. (d).) There are many human activities that are far more difficult, I know, but writing a book is *hard*. Heck, writing is hard. It's such a hack for us humans. So I really truly appreciate all of you who've read what I've written and let me know when it's been helpful or how it could be moreso. Maybe you've heard A Book Apart is winding down. It's rough out there for independent businesses and especially publishers, for real. We're in the process of transferring Just Enough Research and Conversational Design over to Mule and publishing them ourselves. Yes, we are planning future revisions, too. (Mike got out ahead of the whole thing, as he does). If you've bought either of my books in the past 6 months, I'm not going to be seeing any royalties from that. Bummer. So it goes. A bunch of you did buy books, and that part matters to me a lot. What I can do right now, is make Conversational Design available as a free download for a little while during this interim period.
