How did a contractor lose $23M due to a 'Verbal-Contract'? Our case study today explores one of the most common phenomenon often observed in PPP projects about 'verbal-contracts' Very often in order to avoid the procedural pain of getting a written-contract approved, contractors and procurers engage in verbal-contracting mechanisms to carry out additional work assignments. It may work out sometimes but not always. The case of the re-carpeting of the roads in the Nairobi Central Business District is a classic example of how things may go wrong when stakeholders engage in verbal-contracts. It leads to loss of revenue, time and resources and creates a negative impact on the overall image of the project in the long-run. The case study today is a learning for many to never engage in informal work assignments where the possibility of legal issues are high. This certainly would not be the first of its kind incident and there would be many more such examples. The release of this Practice Note is a significant milestone for New Zealand’s road safety initiatives. The collaborative effort in the research and development of this document highlights the importance of multidisciplinary approaches to address complex issues like road safety in temporary traffic setups. The backing by major industry players and the integration of international best practices suggest a solid, well-rounded approach to TTM. By focusing on vulnerable road users, a group often overlooked in traffic management planning, the Practice Note addresses a critical gap in existing guidelines. This can potentially reduce accidents and enhance the safety of pedestrians, cyclists, and motorcyclists, who are disproportionately affected in traffic-related incidents, especially in temporary traffic setups. Moving forward, the implementation of these guidelines and the continuous improvement of such practices will be key. Observing how these new guidelines are adopted on the ground and their impact on road safety will be crucial. This kind of documentation not only informs but also inspires other sectors to adopt similar comprehensive and thoughtful approaches to complex issues. Today, we published a Practice Note for the Protection of Vulnerable Road Users in Temporary Traffic Management Environments. Over 800 hours were spent with over 1000 publications, standards, and legislative instruments were distilled to compose a first-of-its-kind guidance document covering vulnerable road users in temporary traffic management. As NZ's TTM sector moves toward a risk-based approach following the publication of the NZ Guide to Temporary Traffic Management and WorkSafe New Zealand's guidance, Keeping Healthy and Safe while Working on the Road or Roadside, we need better tools and guidance to improve capability and decision-making for practitioners (at all levels, including clients and designers as well as contractors, sub-contractors and field staff). Practice Notes like this one will be important for setting expectations for performance for TTM and giving clarity to people across the contracting chain who engage with TTM on what good looks like.
