It seems like another product is ready for the class action lawsuit steam train, this time in Europe. This one claims to be "Packed full of Fiber." XOXO Soda just gained an additional 1000 doors of distribution in the Netherlands. Their website claims 8g of fiber, while at the same time, their label claims 2.5g. When the industry wonders why consumers are skeptical and mostly untrusting, this is why. Small companies over-claim and over-promise, while big companies have learned how to say something without saying anything. "Made with Natural ingredients," for example, doesn't mean natural; it just means that it contains some natural ingredients; the rest doesn't have to be. Europe used to be the beacon of conservative claims, but now it looks like they may be slipping into the same traps we face here in the US. Thanks for shining a light on this, Andrea Hernández. It all starts with the fact that the FDA is so backed up and under-resourced, unable to manage the enormous task of governing the US food and drug system. This results in a "Self Regulation" status, which gets hijacked with baseless marketing claims, each more sensational than the next, to get the attention of a consumer eager to believe the next wonder elixir. The ones making CPG companies think twice about false claims are not the FDA, it is the ever-feared class action law-suit being championed by opportunistic ambulance chasing lawyers looking for a quick buck off CPG companies making claims they can't back. Small CPG companies play a little game of Russian Roulette here to see if their wild claims can pump sales to the point that a big CPG buys them before they get sued; we have seen many times when they get acquired, the acquiring company have to immediately cease all claims for the same fear of being sued, a classic example being Liquid IV post Unilever acquisition.

Thursday Edible Thoughts: At first, the brownie was king. It was usually homemade and would blast your face off with THC. Then, cookies came around. Then, gummies absolutely took over shelves - likely due to more access to industrial equipment when folks had more access to capital, generally (hats off to the founders who made gummies in their kitchens, btw - wish I could try those first couple batches). Now they're 75%+ of edible sales. This ratio doesn't hold in non-medicated snacking. 'Non-chocolate chewy candy' does like $5.8B in sales, and 'cookies' do $8.6B. Why do we prefer medicated gummies by a huge margin over other edibles, but not non-medicated gummies over other treats? Stronger brands? More aggressive sales teams? Convenience?
