🥇👏 🎉 PLANNING APPEAL SUCCESS 🎉 👏 🥇 Although we should point out, that this Appeal could have been avoided if the LPA had given weight to our argument concerning the status of Neighbourhood Plan policies when considered against the Local Plan. APL'S Denise Knipe supported the Architect with a resubmission application for a single dwelling on the edge of a village. There was conflict between the Neighbourhood Plan and the Local Plan where windfall development was concerned and strategic polices. Section 38 (5) of the Planning and Compulsory Purchase Act (2004) states that if to any extent a policy contained in a development plan for an area conflicts with another policy in the development plan, the conflict must be resolved in favour of the policy which is contained in the last document to become part of the development plan. In this case, the Local Plan was adopted after the Neighbourhood Plan, and on this basis the local plan policy must take precedence. The NPPF at paras 29 and 30 add further weight to this position. Despite presenting this argument for the application the Council refused the outline application citing conflict with the Neighbourhood Plan. We submitted the Appeal and although its taken 10 months the Inspector has allowed the Appeal endorsing section 38 (5). #justsaying #planningappeal #townplanners #planningsuccess #success #planningapplications #collabortation #architects

⚠ URGENT ACTION NEEDED ⚠ The planning system simply does not work for small and medium sized builders. Legislation is bloated and often contradictory, delays are endemic and the National Planning Policy Framework is being ignored in many areas. The number of planning applications granted approval across Great Britain fell to its lowest in nearly 20 years in the 12 months to March 2024 – clear evidence that the system cannot provide the housing pipeline we need. As a result, regional and local builders are being thwarted in their attempts to build the sort of homes which reflect their communities’ needs and heritage, with small housebuilders contributing just a fraction of the homes they delivered 30 years ago. The system has to be reformed to become quicker, more streamlined and with less red tape, with dedicated resources to ensure that smaller builders can create the homes people actually like and want.

If the planning departments were all classed as a political party, and if there was an election system to decide on either keeping these broken systems and the obstructive operators who ignor thier own policies, or replace them with a new organisation that actually cares to help, cooperate and facilitate in providing new homes and encourage SMEs to rise and help to build better home rather than the pure focuse on social housing, I am sure this current rediculous, broken and unworkable system would have been gone many years ago. There is nowhere or no one that we can go to raise our serious concerns and expect a positive outcome. This is truly outrageous, especially as they are crying out for more new homes to be built. There is simply NO LEADERSHIP. I would love to see a group formed, maybe by the SME builders to stand up to this obstructive planning system that is destroying good intentions and healthy businesses just because they CAN be obstructive and ignor even thier own policies.

🏠32,801 Commencement Notices for new homes in 2023🏠 The latest Department of Housing, Local Government and Heritage monthly figures on the number of Commencements Notices (residential construction starts) show that 32,801 Commencement Notices for new homes were received last year. This is the highest number on record and an increase of over 21.5% compared to 2022. it is the highest number of annual residential commencements since records began in 2014.
