⚽❌ Is the European Super League back? While most football fans believed the idea to be over for good back in 2021, this week's revival is an unwanted Christmas gift for many.
In The Athletic, our own sports law expert Catherine Forshaw explains the latest developments through a legal lens.
"The judgment interpreted EU law and the validity of the proposed action; it did not decide the dispute", she writes.
"The fact that we have already seen A22 release another proposal for new competitions with 64 men’s and 32 women’s teams playing midweek matches in a league system across Europe just hours after the judgment is a clear indicator that there is still a lot more to come.”
“Currently these clubs face a 30-point deduction if they attempt a similar move in future and the Premier League has also asserted they will face a £25m fine if they attempt another breakaway. There are too many deterrents facing Premier League clubs presently; but ultimately, it will be the national courts which will determine the outcome and success of the ESL.”

Frozens love to grease The Powerful to keep their ‘impede progress’ plans rolling…
While this PBS piece was shot pre-Natty showdown, it is worth a watch as it summarizes the NCAA plan to enact their two-step process to stay in power by
1. Talking about offering a small amount of yearly $$$ to ‘student-athletes’ (in a proposal that has more holes than a block of Swiss cheese), to buy them some time…and,
2. Using that time to convince their fellow Frozens in Congress(!?!) to enact laws to keep them in power—like those folks don’t have more pressing matters to attend to than sticking their noses into the money-dripping poopshow of college sports?
But, this is one of ways Frozens keep their scams rolling: coddle up to money-hungry, powerful bureaucrats to write laws no constituents are begging for and then vote them into power. 🤷💸🤯
In addition to Rachael Coulsting's excellent blog on Dennis which I mentioned in my earlier post, it's worth flagging that #MHCLG issued a consultation yesterday on speeding up the planning system, which includes questions around the scope of s.73B TCPA.
For anyone involved in #planning it's definitely one to engage with.

According to the #NationalSportsAct2023, only arbitrators appointed by the Minister are allowed to arbitrate sports disputes.The parties to a sports dispute may choose atleast three arbitrators from the list of the appointed arbitrators .The Minister appoints arbitrators from nominations made by the National Council of Sports and each national sports association or national sports federation.
