The habit to know more This year I have been in a habit of joining law seminars. I have found that seminars gives you an opportunity to explore various aspects of the law within a very short period of time. The Q and A sessions held during these lectures gives attendees an understanding of the practical problems that attorneys are facing on a regular basis. So many things for the small business owner or non-profit to be aware of. Don't skimp and create a contract without legal consultation. If your hire knows the law better than you do, it could be a costly error. Don't think a set of values, or a robust company culture, or any homage to DEI will cover you. As they say, ignorance of the law is no excuse. And let's face it, you owe it to your employees to have a proper contract in place that protects them also. I find these nuances of employment law fascinating - knowing your local as well as provincial/state federal laws can save you from litigation that could break a start-up or family business. New court of appeal decision reminds employers to “Beware of fixed term contracts!” Many employers see fixed term contracts as a good way to limit exposure at the end of employment. But what happens if the employment ends early? This was the question faced by the Ontario Court of Appeal recently. If the contract has an enforceable, early termination clause, the employee will be paid in accordance with that clause. However, as anyone who follows employment law knows, many termination clauses get struck down by the court as being invalid. So what happens in that situation? In the case before the court, the employer argued that the fixed term clause in the contract was a form of termination clause and should be struck out. All 3 judges hearing this case disagreed and ruled that it wasn’t a termination clause. What does that mean? It means that the employee is entitled to be paid in full to the end of the term of the fixed term contract, with no duty to mitigate. That’s true even if that will result in someone who worked with the company for 2 weeks being paid for 2 years. So I repeat, be aware and beware of fixed term contracts. Kopyl v. With a potential UPS and International Brotherhood of Teamsters strike looming, it reminds me of a union strike from the not-too-distant past. Toys"R"Us expanded into Sweden in 1995 and did not understand the significance of unions or the solidarity amongst Swedish workers. Toys"R"Us, per company policy, would not sign a collective agreement which was standard in organizations throughout Sweden. So, the 150 employees went on strike. The employees had the support of the Swedish people, in which roughly 70% belonged to a union. When Toys"R"Us refused to back down, citizens of other unions began to act during the 3-month strike. ⚠ transport workers stopped delivering to Toys"R"Us stores ⚠ warehouse workers wouldn't handle the shipments ⚠ bank workers refused to process the transactions UPS workers are asking for higher pay, more full-time positions, and better workplace and safety conditions. According to their website, UPS 'is one of the world’s largest companies, with 2022 revenue of $100.3 billion, and provides a broad range of integrated logistics solutions for customers in more than 220 countries and territories. The company’s more than 500,000 employees embrace a strategy that is simply stated and powerfully executed: Customer First. People Led.
