Thoughts everyone? A free market only works effectively with a free flow of information, which means that we must bring transparency to PBMs' shady practices as a first step toward reining them in. Lawmakers should also consider delinking PBM earnings from drug prices, so that they no longer benefit from driving up costs for patients. And they should consider requiring PBMs to share the savings they extract from drugmakers in the form of lower copays or coinsurance.

Anderson 💬: It’s time for Congress to reduce patients’ drug costs, to stop PBMs from forcing pharmacies to fill prescriptions at a loss, and to ensure Americans can access the pharmacies and medications that are right for them.” “If the 118th Congress closes its doors without enacting these reforms, they’re closing the doors on Americans and pharmacies…Congress needs to stand strong and get this done.” NACDS emphasizes that all branches of government at the federal and state levels must act to bring about comprehensive PBM reform and that Congressional action in the 118th Congress is essential.

CLIENT ALERT by Tripp VanderWal and Brett Liefbroer, "Biden Administration Drops Appeal of Prescription Drug Copay Accumulator Program Lawsuit." On January 16, 2024, the U.S. Department of Justice moved to withdraw its appeal of a recent decision of a D.C. federal district court regarding the use of prescription drug copay accumulator programs. Specifically, by not pursuing an appeal, the Biden Administration will not seek to reinstate a rule that explicitly allowed group health plans to exclude prescription drug manufacturer copay assistance from participants’ out-of-pocket maximums (a practice known as a copay accumulator program). The D.C. federal district ruling means that the 2020 Notice of Benefit and Payment Parameters rule will remain in effect until the Department of Health and Human Services issues a new rule.
