📣 PSA 📣 Today, HubSpot launched a public beta that enables Enterprise customers to store protected health information (PHI) covered under HIPAA in HubSpot’s Smart CRM. Enterprise customers can also store PHI covered under HIPAA in their HubSpot account by enrolling in the public beta and turning on HIPAA-specific sensitive data settings. This includes personal information from covered entities and business associates subject to HIPAA, fitness information, wellness information, and sensitive personal data as defined under GDPR such as the health information of individuals. To get started with sensitive data, your should: 1️⃣ Log in to your account and go to Settings > Privacy & Consent. 2️⃣ In the Data Privacy tab, click Configure sensitive data settings. 3️⃣ Select the types of sensitive data you are permitted to store (personal, financial, or health/medical). 4️⃣ If you would also like to participate in the public beta for HIPAA-covered information, you can select this option. Doing so will opt your account into the beta.

Have you heard the big news???? 🏥 HubSpot is now HIPAA compliant!!! 🏥 This week, HubSpot has rolled out a public BETA for HIPAA-compliant data storage via their Business Associate Agreement (BAA). Much like Salesforce has had for years, Enterprise customers can now store PHI (Protected Health Information) compliant with HIPAA regulations in their HubSpot account. Here's some exciting news: you can now store protected health information (PHI) directly within HubSpot! This beta feature allows you to create special properties and upload attachments that meet HIPAA compliance standards. Here's a quick rundown of how to get started: Do your research: Before diving in, familiarize yourself with HubSpot's resources on storing sensitive data and HIPAA compliance. Enable HIPAA settings: Head to your HubSpot settings and navigate to Privacy & Consent. There, you'll find the option to configure sensitive data settings. Make sure to select the "Health/Medical Data" checkbox and confirm you're a HIPAA covered entity. Create PHI properties: Super admins can mark specific properties as "sensitive" and designate them for storing PHI data. These properties will function just like other sensitive data fields but will be categorized as holding HIPAA-protected information. Upload secure attachments: Depending on the upload method, certain attachments receive an extra layer of encryption within HubSpot's storage. For specifics, check out HubSpot's knowledge base article on protected files. What's the difference between HIPAA and a hippo? They're both large and powerful creatures you should be concerned with but you should try to avoid hippos if you're in the Nile whereas if you try to avoid HIPAA you're in denial. With penalties up to $50,000 *per violation* for 2024 (and even higher for the current 2023 rates still in use), you literally cannot afford to ignore the newly strengthened HIPAA regulations. So what should you be doing about it? - Educate EVERYONE about the issue. And "everyone" means your whole organization not just your marketing team. HIPAA is a consideration that's relevant to your entire organization, so everyone needs to be aware of it. Ops needs to understand it so they approve your call tracking solution. - Assess your risk in an unflinching way. Even if you were in compliance previously you may not be now. Loop in your compliance and IT teams to analyze your digital properties and assess the risk you have currently. Tools out there that can scan your site quickly like Freshpaint's. - Create a compliance roadmap. Presuming you want to avoid costly violations in the future, you'll want plans for how you're going to ensure all of your marketing technology is HIPAA-compliant going forward. Build out an implementation roadmap based on what your organization needs. - Start with low-hanging pixel-fruit Almost everyone was using Google Analytics tags and/or Meta pixels, because that was once the best practice. Now it's a HIPAA breach, and an obvious one that's easy to remove. So address that now, rather than adding it to a two year roadmap to accumulate violations in the meantime. And pixels are just the start... chatbots, forms etc can be non-compliant. Working in the fast-paced world of healthcare marketing means you have to be aware of the changing landscape and right now you need to be aware of the HIPAApotamus. been chuckling at this whole damn post. #HIPAApotamus #healthcare #marketing
