He has raised Trump lied about ‘fraud’ of election and a J6 crime he isn’t alleging. Big legal problem. Is lying a crime? In some specific circumstances such as under oath, yes. Other circumstances, not a crime. Burden of proof is on the prosecution. He has set his own bar, potentially beyond his reach, or technically improbable, on J6 crime he isn’t alleging. Unless, if presiding judge allows prosecutorial misconduct and limits Trump’s defense ability to present facts, which has been previously established by precedent set by DC Judges in J6 unconstitutional proceedings & rulings, (including pre-trial detention). Presiding Judge, has record reflecting she has sentenced J6 defendants to sentences greater than established sentencing guidelines’, Shapiro (paraphrased).

This Thread illustrates so many challenges appellate litigators face. How do you manage your client's expectations? You may have the right to appeal, but would a win even be a win? Is it worth the investment of time, energy, and money? And the appellate lawyer needs to consider what happens after you win. I have heard many criminal defense lawyers lament that they secured not guilty verdicts for a client on a serious charge, but the client wants to appeal the conviction for a lesser-included charge. Maybe there is a viable argument for a new trial, but can you be sure you'll get a better verdict at the retrial? There's more appeals than just research and writing.

If Judge Juan Merchan or Prosecutor Alvin Bragg failed to provide the truth, the whole truth, and nothing but the truth to the jury in the Trump Document Case, it could be seen as potential jury tampering. One report indicates that the Trump Attorney requested specific information on the law, which the Judge disallowed, claiming it was already covered in the case. Why did the Judge not provide the jury documents to the jury? Additionally, what was the Federal charge in question, considering the State lacks jurisdiction over Federal charges? #LegalSystem #TrumpDocumentCase #JuryTampering What do you think?

A interesting perspective on the extent of confidentiality in litigation. Routine advice for drafting emails is to not say anything you wouldn't want reported in the news. Perhaps that should also be a factor for commencing or seeking settlement in litigation. Sure, you can designate those kinds of embarrassing documents as "confidential" for discovery purposes, but mean it can be kept under seal once it becomes part of a motion. Hmm, maybe the Fox Corporation should have considered that before they got to the steps of the courthouse.
