It was a great honour to have met the Right Honourable Sir Geoffrey Vos, Master of Rolls and Head of Civil Justice in England and Wales, at the Lecture and Grand Dinner organised by the Honourable Society of Lincoln's Inn Alumni Association, Malaysia. Sir Geoffrey spoke on a topic particularly relevant to my portfolio in Bar Council as the Chairperson of Technology, Cyber & Privacy Laws Committee. He shared about how dispute resolution will look like due to technological advancement, which covered the procedural aspect, the contexts considering AI implementation, future disputes, developments of law, and future legal practice, the role AI will play in resolutions and judicial decision-making. I took copious notes. He also touched on ChatGPT, the risks and how it can be used, which is exactly the scope of the paper which my committee has produced, which was just passed by the Bar Council for publication to all Members of the Malaysian Bar very soon (please look out for the Circular!). I briefed him as much during our short interaction after his lecture, as excited as I was. The key sentence from his lecture that kept ringing in my head was, "The rule of law cannot be sacrificed at the temple of modernisation." He repeatedly highlighted the need for serious legal thinkers to address the many issues in the Digital age (which each and every member of the Bar Council and its committees, especially the Technology, Cyber & Privacy Law Committee are), the key tenets of upholding the rule of law cannot be compromised. #lawandtechnology #lawandjustice #artificialintelligence #ruleoflaw

Opponents of the law, who include significant tech companies like WhatsApp and Signal, claim that it compromises fundamental rights by endangering privacy and encryption. Additionally, they caution that a large number of false positives from the AI detection systems could overwhelm law enforcement. ⚖️Further delays resulted from the representatives of EU member states being unable to agree on the proposal at a recent meeting. The Belgian presidency had hoped to complete the negotiating mandate; however, differences between the member states impeded their efforts. Discussions on the proposal are expected to continue during Hungary's upcoming EU Council presidency due to the ongoing division. ⚖️Proton founder Andy Yen and Signal Messenger President Meredith Whittaker are among the opponents of the proposal who highlight the risks associated with widespread surveillance and the necessity of more focused methods of child protection. On July 2, Vietnam published a draft Digital Technology Industry Law, to lay down new rules for digital technology products and services, including AI. > AI systems will be regulated based on risk classifications, and labelling requirements imposed. > The law excludes from its ambit digital technologies used for defense, security, and cryptographic purposes. > The law will replace provisions applicable to the IT industry in the Information Technology Law. Deacons IP Partners Ian Liu, Amy Chung, and Theresa Luk had a remarkable experience attending the Asia Pacific Conference in Shenzhen co-hosted by the Licensing Executive Society China (LESC) and the LESC Hong Kong Sub-chapter. The conference was attended by over 140 attendees from Mainland China and other jurisdictions. The speakers delved into the fascinating realm where law and technology intersected, with a specific focus on the applications of artificial intelligence (AI) and how technology promotes IP commercialisation and dispute resolution. Ian, in particular, had the privilege of being a speaker at the event, shedding light on the immense potential of AI in the legal field. His talk covered various aspects, including AI-driven case management, digital courts, AI contract review, and pre-trial risk assessment tools. He emphasized the need to address concerns related to transparency, accountability, explainability, biases, and validation in AI algorithms and data. The trio found themselves inspired by the innovative ideas shared and the engaging discussions that revolved around the evolving role of AI in law and justice. It was a wonderful opportunity to learn from industry experts and exchange insights with fellow professionals. The conference ended with a fascinating tour and dinner at Huawei’s beautiful European-style headquarter in Dongguan.
