Recent changes to New York’s Property Condition Disclosure Statement Act (“PCDSA”), which go into effect on March 20, 2024, have notably eliminated the option for a seller of residential real property to provide a $500 credit to a buyer in lieu of providing a fully completed Property Condition Disclosure Statement (“PCDS”). Additionally, new questions regarding flood related information were added to the previously existing PCDS, along with other changes requiring the disclosure of mold. The purpose of the changes are to provide a greater level of transparency regarding the condition of real property to a buyer and to increase seller's responsibility to disclose accurate historical information regarding such real property.
