Artificial Intelligence in Legal Documentation Review: The Challenges Posed by Cultural Bias The advent of Artificial Intelligence (AI) has engendered significant transformations across diverse sectors, and the legal profession is not exempted from this technological revolution. Particularly, the incursion of AI into legal documentation review is becoming increasingly vivacious. The automation of tasks traditionally regarded as laborious and time-consuming, such as the review of standard contracts against fixed formats, due diligence deep dive, and laborious discovery processes, has the potential to drastically reduce the number of man-hours expended while enhancing the efficiency and precision of legal procedures. However, the implementation of AI is not devoid of its conundrums, with cultural bias emerging as a salient issue. AI in legal documentation review principally employs machine learning algorithms to decipher and interpret legal documents. These algorithms are trained on copious amounts of data, encompassing past legal cases, legislation, and legal treatises. They have the capacity to discern patterns, formulate conclusions, and even propose potential outcomes based on the data they are fed. The convenience, rapidity, and cost-effectiveness proffered by AI are indeed remarkable. Nonetheless, an inherent issue emerges from the data used to train these algorithms. Legal documents, like all written texts, are imbued with the cultural context of their creation, and as such, harbour underlying cultural biases. The legal profession is not immune to such syllogisms and cultural predispositions. These favouritism toward a certain line of thinking may be unwittingly assimilated and propagated by the AI systems, thereby making the eradication of all forms of bias, cultural or otherwise, a formidable challenge in the application of AI to legal document review. Cultural bias in AI can materialise in various forms. For instance, an AI system trained on legal data from a specific country or jurisprudence may not exhibit accurate performance when applied to legal documents from a distinct cultural milieu due to disparities in legal systems, societal norms, and linguistic variations. This could precipitate the misinterpretation or incorrect analysis of legal documents, leading to serious legal repercussions. Furthermore, AI systems can inadvertently perpetuate and magnify existing cultural biases present in the training data. If the legal documents used to train the AI system contain cultural biases, the AI system will absorb and reproduce these biases. This is particularly disconcerting in areas such as sentencing and bail decisions, which can have profound implications for the individuals implicated.

Thanks to my colleagues, I came across a review on how lawyers' work is being optimized with AI tools. The thing is, the review pointed out that misusing AI can lead to big mistakes, especially during legal proceedings. It's also mentioned that humans typically produce higher quality results. But here's the kicker: AI tools can save attorneys a ton of time on the mundane stuff, and it's pretty evident. But let's be honest, automating the review of charters or contracts isn’t exactly groundbreaking. A lot of law firms have been on this train for a while now, skipping the manual proofreading of lengthy contracts. So, the big question is, can we trust the machines? Analysts who automate processes for extracting information for analysis often also write algorithms to validate the results of this automated process, or even double-check them. We probably do not rule out the use of this possibility (double check) by lawyers. In any case, with the help of AI we can save time in one way or another. The only question is that in order to save time, it is necessary to teach lawyers a new language of communication with AI. So, which choice is better: teaching AI the language of a lawyer or teaching a lawyer the language of AI? What do we want to do with lawyers' time here and now? I choose the first one, it seems reasonable to me. Otherwise, as in Frank Herbert's Dune (or maybe it was already his son), and it seems that at the end of the last novel of this franchise the main character, having inhaled spices, himself turns into a giant Worm, which produces these spices. In short, for all our enthusiasm for AI, you can't trust anyone but yourself and your own lawyer's instincts. This is a good article from the The Register about AI and LLMs. I have posted many times about laying strong foundations in your legal tech and process before trying to embrace any AI in your business. It also debunks some of the snake oil being shipped around linked in.. Yes it can pass the bar and we all probably can with a whole load of study but I certainly will never have the experience. What I can do is lend my experience to helping your firm make improvements. A recent project I lead utilised an LLM tool to read mortgage offers from different lenders and use that data elsewhere in the process. The objective here was to reduce human input errors, fee earner touch time and ultimately preparing the file ready for completion quicker. Yes it uses an LLM and is way more accurate than OCR or text stripping etc but the end goal is the same. AA = Accurate Automation I've seen countless advertisements on linked in. Law firm owners are busy people so keep it simple.. "If its repetitive and a human does it now, you can replace that with some software that reads the doc and updates your system". Or the Linked In - Sales Person Post: "Imagine having a super-smart assistant who never sleeps, gets tired, or makes mistakes. This is what our cutting-edge RPA technology, powered by an advanced AI language model, offers. It's like having the brain of a genius at your fingertips, ready to automate and streamline your business processes with unparalleled efficiency and accuracy. This AI isn't just smart; it's like having Einstein helping you out, but without the need for a coffee break. It learns from your needs, adapts to your specific business requirements, and consistently improves over time.
