The percentage of liquidations as the chosen closure mode for overall IBC cases saw a significant drop from 60 per cent in December 2019 to 44 per cent by September 2023, based on IBBI data. This shift indicates a crucial change within the IBC framework, primarily shaped by the economic status of companies entering the Corporate Insolvency Resolution Process (CIRP). In discussions with Business Standard, I delved into the evolving landscape of India's insolvency ecosystem, providing insights into the changing dynamics at play.

#ibc has been playing its role in resolution of stressed assets since its beginning and after initial years of warming up and settling in, it has started to yield results successfully. The data provided by IBBI is quite encouraging, and IBBI has played its role efficiently thus far. We must keep in mind that we had 2 years of extremely challenging times during Covid, and that even thereafter, we have come out with success. 273 may not look like a significant number as compared to the number of matters pending before various NCLT's across the country, but then with the magnitude of challenges involved in resolution of stressed assets, we are getting their, and fast!! INSOL India, Academic Committee proudly presents the paper “An analysis of continuation bias under the IBC regime”, with REDD Intelligence as knowledge partner. Authored by Gausia Shaikh, the paper addresses a gap in research on India's Insolvency and Bankruptcy Code, focusing on continuation bias. This bias reflects a reluctance toward liquidation, emphasizing reorganization of insolvent companies. The paper underscores the IBC's primary objective: timely resolution of struggling companies through restructuring or liquidation. It also offers recommendations to reduce, and eventually eliminate, continuation bias within the IBC framework.   The paper will be launched during a Panel Discussion on Re-evaluating Liquidation: A New Perspective to be held on 12 April 2024 at 3pm IST. Government's 2020 amendment to the Insolvency and Bankruptcy Code (IBC), raising the threshold limit from 1 lakh rupees default to 1 crore rupees, is a significant step which has benefitted MSMEs keeping in mind they are the backbone of the Indian economy.
