In the foyer of his 12-room co-op overlooking Central Park, financier Clifford Press is hunched over, trying to persuade his 14-pound Jack Russell to stop showing her belly. Behind him, sunlight streaks through the cavernous living room, adorned with gold mirrors, hardwood floors, and a working fireplace. The building, 1120 Fifth Ave., is a dense nexus of wealth, home to Michael J. Fox, Nelson Rockefeller’s daughter, and heirs to the Sears and Toys "R" Us fortunes. It should be a respite from New York’s loud streets. But Clifford Press is a man at war. His enemies, he tells The Daily Beast, are the relative peasants on the “B and C” side of his building who sit on the 11-person co-op board. “They’re in the sort of cheaper apartments,” he said. (Those units are generally worth $5 million to $10 million, while his is worth at least eight figures.)

Here is a good news story on a case my firm is handling now--it involves the Ellis Act, the state law that prohibits cities from interfering with landlords who might want to go out of business. The factual question to be answered is whether Douglas Emmett, the publicly-traded REIT, was actually planning to "go out of business" at Barrington Plaza and remove all the apartments permanently from rental housing use when it served 558 eviction notices on its tenants. The legal question to be answered is what does "go out of business" mean? I have strong opinions on both questions, obviously! 😄 https://lnkd.in/gvjunKjr

https://lnkd.in/eVmmtd8P In this WSJ article, writer Deborah Acosta lays out the pending doom in the Florida condo market, triggered by a recent state law forcing older buildings to meet much stricter standards following the Surfside condominium collapse catastrophe in 2021. The law essentially requires inspections for all condominium and coop buildings 3 or more stories, to determine their structural soundness. The results are potentially huge assessments against the owners to pay for repair and maintenance programs, as well as maintaining requried reserves. "In Miami, about 38% of the housing stock is condos, the highest of any major metropolitan area in the U.S., according to Zillow. Of those buildings, nearly three-quarters are at least 30 years old. For those that have large repairs looming, many owners are scrambling to sell before Jan. 1 when building reserves must be fully funded to be in compliance with the law." All of this is on top of increased insurance costs due to recent storms hitting Florida's real estate market. As a result, owners in these older buildings are reducing prices significantly. One result, may be that savvy developers, eyeing to score water front real estate on the cheap, will buy their way into existing older buildings with the aim of taking over and eventually orchestrating the sale of remaining units, to ultimately knock down buildings and build new luxury units.
