Esteemed scholar Tom Baker will deliver the keynote address, "Funding and Insurance: Friends, Foes, or Frenemies." Tom Baker is the William Maul Measey Professor at the University of Pennsylvania Carey Law School, with a secondary appointment at the Wharton School of Business. He serves on the editorial boards of the Law & Society Review and the Journal of Law & Empirical Analysis. Recently, he was honored with the 2024 Harry J. Given last week's #USHouseofRepresentatives hearing about the potential #nationalsecurity threat caused by #litfunding, I thought some perspective may be appropriate. The CBS article linked below discusses the theft of trillions of dollars of #IP through a sophisticated state sponsored #hacking operation. Does any serious person believe that if a state actor wants to pilfer US #intellectualproperty, (like the operation discussed by #CBS), that the real way to do it is not with proven and effective #military grade #cyberwarfare, but instead by taking an LP interest in a #litigationfunder? Why use overwhelming hacking power which gets you unfettered access to all information when you could instead put money into a #patent lawsuit, wait years for discovery to start because of #IPRs, 101 motions, transfer motions (and of course writs of mandamus if/when such motions are denied) and then, and only then, potentially (and in violation of Protective Orders) look at a limited set of documents? Perhaps the invocation of national security is being used by powerful #lobbying groups to eviscerate the ability of both parties in the #litigation to have the financial means to engage the best #attorneys and #experts such that cases are decided on the merits as opposed to which party can outspend the other. #TPLF #legalfinance #LFA #litfundingbrokers #accesstojustice https://lnkd.in/ebyVuVE2

With litigation funding in the spotlight, this report for the Legal Services Board by Professor Rachael Mulheron KC, the leading academic in the field, provides some much-needed, data-backed, well-researched arguments for and against. The 197-page report looks across 44 consumer cases involving litigation funding from a consumer perspective and as it relates to the Legal Service Board's regulatory objectives as set out in the Legal Services Act 2007. It has also been shared with the Civil Justice Council ahead of their upcoming review of the litigation funding market. Some of the key headlines are: ⭐serves the public interest by funding litigation that would and could not otherwise be brought; ⭐improves access to justice, without which any substantive law means nothing if there is no means by which to test it; ⭐has given consumers an "enhanced appreciation" of their rights, through cases like the Post Office sub-postmasters; ⭐may lead to a less-than-favourable economic outcome for the funded client; and ⭐the risk around the sources of funding such as foreign non-ALF member funders. It also sheds to light some other aspects often not discussed, such as how funding: ⭐ provides a considerable degree of financial resilience to law firms; ⭐ may encourage more effective costs-budgeting; and ⭐ should be allowed to recover their costs from the losing defendant in a successful outcome. In doing so, it raises critical questions which clearly need to be considered itself as part of the terms of reference of the CJC review, for example (but certainly not limited to): ⭐the JUSTICE tax that the UK judiciary inadvertently imposes on victims of wrong-doing due the non-recoverability of solicitor uplifts, ATE Premiums and funding costs; ⭐the absolute level of costs in general and how it impacts the economic reality of litigation funding; ⭐how it can impact the conduct of litigation by both claimant and defendant law firms. We heard the story first hand at last month's inaugural LF Dealmakers | European Edition during our keynote interview. James Hartley at Freeths and Neil Purslow at Therium Capital Management, representing the law firm and the litigation funder, respectively, for the sub-postmasters case, shared their experiences and perspectives - and all that it has taken to bring the truth to light. Now in a piece published by The Guardian today: "Alan Bates has warned of a “concerted effort” by big business to constrain access to the kind of funding that allowed the post office operators to bring a landmark case against their former employer." "Without litigation funding, he wrote, 'what has been called ‘the greatest miscarriage of justice in British legal history’ would not have been exposed'. 'We would never have got to the truth, or been able to open the door to obtain the financial redress the victims are rightfully owed.'" "He added: 'Constraining funders by effectively reducing the number of cases they can take on might serve large corporations with something to hide.
