Court of Appeal confirms CAT Rules do not abrogate accrued limitation defences The Court of Appeal has handed down judgment in Walter Hugh Merricks CBE v Mastercard Incorporated and Others [2024] EWCA Civ 759, upholding the Competition Appeal Tribunal’s decision that the CAT Rules 2015 do not abrogate accrued limitation defences. The effect of the decision is that Mastercard is entitled to rely on a limitation defence in respect of the first five years of the Merricks’ class action. Tribunal rules Merricks’ class action is partially time-barred The Competition Appeal Tribunal has handed down judgment in Walter Hugh Merricks CBE v Mastercard Incorporated and Others [2024] CAT 41 holding that the first five years of the Merricks’ class action is time-barred, rejecting Mr Merricks’ case under section 32 of the Limitation Act 1980 that Mastercard deliberately concealed relevant facts or deliberately committed a breach of duty. Trade mark infringement claim dismissed and counterclaim for revocation successful: Engineer. ai Global Ltd v (1) Appy Pie Ltd (2) Appy Pie LLP [2024] EWHC 1430 (IPEC) On 19 June 2024, HHJ Melissa Clarke (sitting as a Judge of the High Court) dismissed a trade mark infringement claim brought by Engineer. ai against Appy Pie in reliance on a number of BUILDER formative trade marks. Engineer. ai and Appy Pie are competitors in the “code-free” app-building space. The central issue in the action was the extent to which Engineer. ai should have the benefit of a monopoly right in the word BUILDER (and a consequent entitlement to restrain its use by others) OR whether the word BUILDER was at all relevant times descriptive of app-building services (and should therefore be available for use by all traders in the relevant sector).
