The COPIED Act – yet another significant legislative move against the threat of generative AI. Proposed by US Senators this week, the act aims to “protect journalists, actors and artists against AI-driven theft”, by outlining new frameworks for the marking, authentication & detection of AI-generated content. In the wake of the current Suno/Udio lawsuit, and with fairly unanimous industry support from the RIAA and other key stakeholders, the proposed bill is more tangible evidence that infringements caused by AI will not be tolerated. The Illiac Suite was the first example of AI-assisted music production, in 1957. Much simpler than today's complex systems, it used algorithms to compose sheet music for a string quartet. Fast forward to 2024, and generative AI companies are able to compose, produce, mix, and master a complete song in seconds using a simple text prompt – a controversial reality for the music industry. What's the update with Suno & Udio vs the RIAA? In case you missed it, both AI music platforms are being sued by the Association – and its major label members – for committing copyright infringement "at an almost unimaginable scale," without permission or transparency. Since the lawsuit was announced, both Suno and Udio released statements, protesting their innocence on the grounds of 'fair use'. Udio, for example, claimed that their AI is "transformative, [and] is designed to generate completely new outputs, not to memorize and regurgitate pre-existing content." The RIAA hit back, reminding readers that Suno "continues to dodge the basic question: what sound recordings have they illegally copied?” Looking to catch up? The Recording Industry Association of America (RIAA) is suing Suno and Udio, the (arguably) two most popular generative AI music companies. In short, the RIAA & its members - which includes all three major record labels - allege that these platforms have trained their AI models using copyrighted material, before acting evasively when being questioned on this. So what does this mean for the industry? Well, make no mistake, this is the largest industry move against harmful AI so far and, if Suno & Udio are found to be guilty, it sets a firm precedent for the future use (and misuse) of AI to create music. It's important - quoting the RIAA - to "embrace artificial intelligence tools that are responsible, pro-artist, and keep humans at the centre of creativity", while maintaining constant control over any potential harmful developments. If this is achieved, the music industry can look forward to an exciting future, in which AI facilitates the process without overshadowing human creators.
