There's less than month for Districts 1-7 to file their garage inspection before the deadline of December 31st. per NYC DOB Local Law 126. New year, new Sub-cycle has begun! Local Law 126 Sub-Cycle 1B began its filing period from January 1, 2024 - December 31, 2025 in the Community Districts Manhattan 8 through 12; and all of Brooklyn. (see below in map) REMINDER! What is Local Law 126? It mandates that parking structure owners arrange inspections every 6 years and promptly report the findings to the Department of Buildings (DOB). The primary goal is to prevent similar incidents from occurring in the future. These inspections commenced on January 1, 2022. However, it's important to note that not just anyone can conduct these inspections. Only a Qualified Parking Structures Inspector (QPSI) is authorized to perform them and file the necessary reports. Failure to comply with these requirements, including late or non-filing, carries significant penalties. While SB-721 applies to landlords of buildings with at least three multi-family dwelling units and requires inspections every six years, SB-326 applies to condominium associations and requires inspections every nine years. The deadline for initial inspections under both SB-326 and SB-721 is January 1, 2025.

Changes to Part 5 of the Building Safety Act 2022 are being introduced by the Leasehold and Freehold Reform Act 2024 to provide further clarification on the remedies aimed at those responsible for relevant defects. These changes follow a number of cases reported in the First Tier Tribunal, where the scope and meaning of the original wording within Part 5 were the subject of legal argument.
